These Terms and Conditions ("Terms") govern your access to and use of the SleepSync website, the SleepSync application, and any associated research activities (together, "SleepSync"). SleepSync is a research program of Monash University ("Monash", "we", "us", "our"). By accessing SleepSync, creating an account, or enrolling in a SleepSync-linked study, you agree to these Terms.
If you do not agree with these Terms, please do not use SleepSync.
1. About SleepSync
SleepSync is a research program and digital health tool that uses models of sleep and circadian rhythms to generate personalised, evidence-based recommendations for shift workers. It is designed primarily for shift workers and people with circadian rhythm conditions.
SleepSync is a research and educational tool. It is not a medical device and it does not provide medical advice, diagnosis, or treatment. The recommendations produced by SleepSync are intended as general guidance to support healthy sleep and circadian behaviour. They are not a substitute for advice from a qualified health professional.
2. Eligibility
To use SleepSync you must be at least 18 years old and able to enter into a legally binding agreement. If you are participating in a SleepSync-linked research study, you must also meet the eligibility criteria set out in the study's Participant Information and Consent Form (PICF).
3. Research context
SleepSync is delivered as part of ongoing human research conducted by Monash University and approved by one or more Human Research Ethics Committees (HRECs), including the Monash University HREC and, where relevant, HRECs at partner research sites.
Where you are enrolled in a specific research study, the PICF for that study sits alongside these Terms. If there is any inconsistency between these Terms and a study-specific PICF in relation to that study, the PICF prevails.
4. Accounts
You may need to create an account to use some or all SleepSync features. When you do, you agree to:
• provide accurate, current and complete information;
• keep your login credentials confidential and not share them with others;
• notify us promptly if you become aware of any unauthorised use of your account.
You are responsible for activity that occurs under your account. We may suspend or terminate an account that appears to be compromised or that is being used in breach of these Terms.
5. Acceptable use
You agree to use SleepSync only for its intended purpose, i.e. to manage your own sleep and circadian health, and to participate in research if you choose to. You agree not to:
• use SleepSync to provide clinical advice to others or to make diagnostic or treatment decisions for anyone, including yourself, that would normally require a qualified health professional;
• attempt to reverse engineer, decompile, extract, or otherwise obtain the underlying algorithms, models, source code, or datasets behind SleepSync, except where permitted by law;
• access the service via automated means (e.g., scrapers, bots) other than any officially supported integrations;
• upload content that is unlawful, infringes the rights of others, or that is not yours to upload;
• interfere with the security or integrity of SleepSync, or attempt to access any data other than your own.
6. Wearable devices and third-party integrations
If you choose to connect a wearable device or third-party health platform to SleepSync, you authorise SleepSync to receive data from that device or platform for the purposes described in our Privacy Policy. Your use of the third-party device or service is governed by that provider's own terms and privacy policy, and we are not responsible for the accuracy of data those providers supply to us.
You can disconnect a wearable or third-party integration at any time from within the SleepSync application.
7. Privacy and data
Our handling of your information is described in the SleepSync Privacy Policy, which is incorporated into these Terms by reference. In summary:
• SleepSync data is stored in Australia (AWS, Sydney region).
• Identifiable data is accessible only to authorised members of the Monash-based SleepSync research team and authorised technical staff.
• De-identified data may be used for approved research, product improvement, and algorithm training.
• Your information is not sold, and is not used for commercial advertising or marketing. It is not shared with employers or insurers in identifiable form.
• Any sharing with academic research collaborators occurs in de-identified form only and under a formal agreement.

8. Intellectual property
SleepSync, including its underlying algorithms, software, models, scientific documentation, interface designs, and research outputs, is owned by Monash University and/or its licensors and is protected by Australian and international intellectual property laws. All other rights are reserved.
Any data you enter into SleepSync remains yours. By entering or connecting data through SleepSync, you grant Monash University a non-exclusive, royalty-free licence to use that data for the purposes described in the Privacy Policy (delivery of recommendations, approved research, and product improvement using de-identified data).
9. No medical advice and no emergency service
SleepSync does not provide medical advice and is not a substitute for professional medical care. Do not rely on SleepSync for decisions about medical conditions or the safety of operating vehicles, machinery, or performing other safety-critical tasks. Always consult a qualified health professional about any health concern.
SleepSync is not an emergency service. If you are in crisis, experiencing a medical emergency, or thinking about harming yourself, call 000 (in Australia) or contact Lifeline on 13 11 14.
10. Availability and changes
We aim to keep SleepSync available and functioning well, but we do not guarantee uninterrupted access. SleepSync is provided as part of ongoing research and product development, which means features, study protocols, and access may change over time. We may modify, suspend, or discontinue any part of SleepSync at any time, including where a study has concluded.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law:
• SleepSync is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that SleepSync will be error-free, accurate, uninterrupted, or that the recommendations it produces will achieve any particular outcome for you.
• We are not liable for indirect, incidental, special, or consequential loss or damage arising out of your use of, or inability to use, SleepSync.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
12. Withdrawal and termination
You may stop using SleepSync at any time, and you may withdraw from a SleepSync-linked research study in accordance with the relevant PICF. You may also request deletion of your account by contacting us.
We may suspend or terminate your access to SleepSync if you breach these Terms, if a study you are enrolled in concludes, or if we are required to do so by law or by an HREC.
13. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of SleepSync.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last reviewed" date at the top of this page and, for material changes, we will notify active users through the application or by email. Your continued use of SleepSync after a change takes effect means you accept the updated Terms.
